DBSH attorney Jamie Cook has authored a book for attorneys on Iowa Expedited Civil Actions and Discovery Amendments. The book will be published by the Iowa Association for Justice.
Expedited civil actions applies to cases involving $75,000 or less in money damages. The rules permitting expedited civil actions became effective January 1, 2015. The goal of expedited civil actions is to “significantly reduce litigation time and cost, while increasing access to justice,”
The governing rules include limits on discovery and summary judgment motions, an expedited trial, and limitations on the length of trial. The discovery amendments include adoption of the federal initial disclosures scheme (with some modifications), limitations on the frequency and extent of discovery, a discovery plan, and an expert report requirement.
